Kodak Sues Apple, RIM

Eastman Kodak Co. filed suits Thursday against Apple Inc. and Research In Motion Ltd. charging those companies with violating patents related to digital camera and digital imaging technologies. In a filing with the International Trade Commission, Kodak alleges Apple's iPhones and RIM's camera-enabled BlackBerry devices violated patents related to a method for previewing digital images. Kodak also filed two suits against Apple in the U.S. District Court for Western New York, charging Apple with infringing on patents related to digital cameras and certain computer processes.

Cray Inc (CRAY)

Cray Lowers FY 2009 Guidance; Reaffirms FY 2010

Supercomputer maker Cray Inc. said today that based on preliminary results, total revenue for 2009 is now expected to be about $284 million and earnings are expected to be in the range of about break-even to a small loss from operations. Cash and short-term investments as of December 31, 2009 are expected to be above $110 million. Cray retired all remaining convertible notes during the fourth quarter of 2009.

IBM Earns Most Patents 17th Year in Row

IBM Tuesday announced it received 4,914 U.S. patents in 2009, marking the 17th consecutive year it has topped the list of the world's most inventive companies. IBM also announced that, for the first time, it will offer its invention know-how and patent portfolio management software to clients seeking to enhance their intellectual property (IP) management capabilities in support of innovation-based growth strategies.

Supervalu (SVU)

Supervalu Posts Profit, Maintains View for Year

Supermarket company Supervalu, whose regional brands banners include Albertsons and Jewel-Osco, posted net income of $109 million, or 51 cents a share, for its fiscal third quarter. In the year-earlier period, it had a net loss of $2.94 billion on a massive non-cash charge. Sales in the latest period fell to $9.22 billion from $10.17 billion.
Earnings topped expectatations and it maintained its full-year forecast.

Tiffany Says Holiday Sales Up 17%; Ups Forecasts

Tiffany & Co. Tuesday said worldwide sales during the two months holiday season -- the two months ended December 31, 2009 -- were up a healthy 17 percent vs. last year. Tiffany's management said it now believes net sales and earnings for the fiscal year ending January 31st will exceed its previous expectations.

KB Home (KBH)

KB Home Q4 Revenues Down

KB Home, the Los Angeles-based homebuilder, said Tuesday that it had posted quarterly net income of $100.7 million, or $1.31 a share, compared with a net loss of $307.3 million, or $3.96 a share, in the year-earlier quarter. KB said the latest quarter included an income tax benefit of $191.7 million. Revenue for the quarter fell 27% to $674.6 million. The company said average selling prices of a home fell 12% from the fourth quarter of 2008, while deliveries decreased 22%.
Revenues topped analyst estimates.

Deutsche Bank Downgrades Burger King (BKC) to Hold

Deutsche Bank downgraded Burger King Holdings Inc. from Buy to Hold.
Deutsche's analyst said "For fiscal 2Q10 (Dec qtr.), we have trimmed our SSS forecast to -3.4% from -2.7% previously. While this is not a huge reduction, the bigger concern is the current (Mar) quarter. We’re currently at -3.5% SSS, but the Dec/Jan trend suggests this could be too optimistic. We are lowering our FY10E EPS to $1.37 from $1.43 on lower sales and margin assumptions. FY11E goes to $1.58 from $1.66."
